Neither our website nor our services are directed to children under the age of 18. We do not knowingly collect personally identifiable information from anyone under 18 years of age. The Right of Access gives you the right to request from Spark what Personal Information we process. You have the right to a) request whether your Personal Information is being processed, b) request access to your Personal Information, c) obtain a copy of your Personal Information, and d) request to certain supplementary information about our processing of your Personal Information.

  • The right to rectification

You have the right to ask Spark to rectify inaccuracies about your Personal Information. If Spark possesses your Personal Information but you have reason to believe it is not up to date or incomplete, you can request that Spark complete the data with additional Personal Information.

  • The right to erasure/ Right to be forgotten

The Right to Erasure allows you to request that Spark remove or delete your Personal Information from our system.

  • The right to restrict processing

You have the right to request that Spark stop processing your Personal Information.  Please note that even if it stops processing your information upon request, Spark will still be able to store your Personal Information.

  • The right to data portability

You have the request that Spark provide you your Personal information in a structured, commonly used, and machine readable form to allow it to be transferred to another data controller.

You have the right to request that Spark stop further processing of your Personal Information.

  • Rights in relation to automated decision making and profiling.

You have the right to request not to be subject to processing that leads to automated decision-making about you.

  • The right to withdraw consent at any time

You have the right to withdraw your consent at any time.

  • The right to lodge a complaint with a supervisory authority

You have the right to lodge a complaint with a supervisory authority in the EU.  If we do not respond to your request within a month, you have the right to lodge a complaint at the supervisory authority, and seek a judicial remedy.

8.3 Lawfulness of Processing

Spark processes your Personal Information based Article 6(a) and 6(f) of the General Data Protection Regulation (GDPR).  These provisions allow for processing of your Personal Information based on your consent, and when we have a legitimate interest to do so.
